Oro Valley Development and Infrastructure Department Wants To Subvert General Plan

---
In 2003, voters overwhelmingly rejected a zoning code called: "Mixed Use".  This would allow apartments on property otherwise zoned. (Also removed from the plan was the "propery tax."  A property tax is what Mayor Hiremath is talking about when he uses the term: "Sustainable Revenue Source.")

The Oro Valley Development and Infrastructure Department has decided that they have the authority to see a rewrite of the General Plan.  They want Oro Valley to have mixed use zoning!

Tomorrow's planning and zoning commission meeting has an agenda item number 5 entitled: "Minor General Plan Amendment to add a Mixed Use land use category to the text of the General Plan document only OV1111-06.

This is not a "Minor" amendment.

This is simply an end-run around the General Plan.  This will subvert the will of the people as voted in 2005.

The job of the Oro Valley Development and Infrastructure Department is to apply the General Plan and the Oro Valley Codes.

It is not their job to recommend changes to the general plan. They have not standing to do so in our community, regardless of what (spurious) logic they contend.

It is up to us, the citizens of Oro Valley, to write and to plan.

"The proposed general plan amendment would add a new land use category which is designed to ] encourage and implement the new urbanist planning concept for a variety or mixture of land uses, integrated within a single development." (Source: Oro Valley Development and Infrastructure Department Memo Recommending MUP. Paragraph 2)

See our definition of "new urbanism" under "code terms" on the left column of the blog.

Why does the Development and Infrastructure Department think they can do this?

Cares for OV- Perhaps they like the concept of choosing winners & losers? It works so well in other levels of govt, why not in OV?

My guess is this is to accomodate the recent re-zoning of the Linda Vista/Oracle property from NC to high density residential. The developer got this amendment through despite solid logical objections by the surrounding neighbors. He proposes more apts with businesses facing Oracle.

According to zoning's response to a citizen's question, it also enables Beztak to come back & re-apply for his apts + something (under the Mixed use plan) on 2-E at Rancho Vistoso & Vistoso Commerce Loop. Probably could come into play w/ 7-I also. Seems a little coincidental that if this was being worked on for the past yr, no one mentioned it until the developers' legal counsel got involved & began looking for alternative solutions &/or claiming violation of State constitution.

Accommodate = subversion to me....wow manuevering political means.....what the hell. So our Town Council which seems to be among other things :) follow the leader (where did we get Waters?) and the developer (Steve Solomon) THE APPOINTED ONE, is given free rein.....they (that be an ouchey...seeing as who they are) are able to decide on MU zoning.

Makes worthless the PAD that now supposedly applies.

I see One business (hope it is Taco Bell) AND 256 apartments for 2E.

It is very difficult to keep up on the manueverings of The Town

need a definition: The Town...hasbeen without raises, this includes Staff...

In the plan of MU where developers rule, they will get "greased) and most likely raises in salary.
