John Musolf Raises Issue Of Az Open Meeting Law At "Call To Adience"

We appreciate that our friend John Musolf pointed out at "Call to the Audience" at the Feb 2 Council Meeting that as of July 29, 2010,"it is required that the public bodies of Arizona, including public bodies of the state, counties, and cities and towns, to conspicuously post a statement on their website about the physical and electronic locations where all public notices of their meetings will be posted. In the alternative, cities and towns may post a statement on a website of an association of cities and towns stating where all public notices will be posted. The statement must include physical and electronic posting locations."

As John noted,concerning the Jan. 29 Budget Retreat Meeting,this was not done, nor is the agenda listed on the town web site as of today, in spite of the law that requires it be there for a period of 12 months.

To bad, our Town Attorney, when asked to comment on this, was only able to state that Mr. Musolf found his way to the meeting----as if that was the point.

John had noted, he finally found the location of the meeting that he attended, by calling Council Member Bill Garner.

Our take on this?

It's doesn't speak highly of the staff of Oro valley that can't follow a simple Az Statute.

PS--Subsequently, the town as since added the following to the web site,. We believe that was added today.

Unfortunately, the only way to get the Town Attorney's attention is to open your wallet and sue.

If there is a clear violation of state law it should be rectified.

I doubt if many of our dear readers have the extra cash - given the economic downturn = to fund a lawsuit.

What exactly was the TA supposed to say during a public meeting? "Oh yes, you are correct, my client violated the law"? Come on guys - a little common sense here. The TA is not the target to go after in this situation. If there was a violation, then it should be reported to the AG who will investigate accordingly.

cyclone 1--- I would agree with you that the Town Attorney is not the issue. However, keep in mind, it was Council Member Solomon that asked Mr. Rosen to opine.

My issue is with the staff, and who at the town thought it would be appropriate to post the Budget Retreat location & agenda SUBSEQUENT to the meeting.

Someone is trying to cover someone's "backside."

That does not negate the fact, that Mr. Rosen's response did not address the question put forth.
