On Feb 22nd, representatives of "NIMBY"---our neighbors fighting the proposed crematorium near their homes, attemped to appeal the Town Council's decision to approve this facility. They, and subsequently, their attorney were turned away and their attempt to appeal was refused.
The Oro Valley attorney advised they would have a letter of explanation by March 2nd.
It is our understanding that any decision by the Town Council may be appealed to the OV Board of Adjustment. There is, however, this caveat: In "The Review & Decision-Making Bodies" document, Section 21.6 Parag F, it states; " --you must appeal within 30 days of being aggrieved."
We fully expect the town attorney to state, the "30 days have past, so you're out of luck." That may be the case, but we would ask one question: "How do you appeal a decision when you don't even know the decision affecting your well being is made?"
Keep in mind, at the Nov 1 Council meeting when the vote to approve a crematorium was made, the agenda item read: Item 6 OV12-05-35 "Request for approval of a development plan for The Vistoso Memorial Chapel ---"
You will note--- The agenda item made no reference to a "Crematorium." Mr Sinclair, no longer with the town of Oro Valley made the solo determination that a "memorial Chapel" includes a "Crematorium."
So, there you have it. As usual Oro Valley politics leaves the citizen holding the bag. So, what else is new?

If most residents had known that this Memorial Chapel had a crematorium connected with it they would not have been happy with that!
Also the drawing of the plans did not show where there would be an area for the burning or smoke, etc.
How was this approved by the DRB?
Did the DRB even know that a crematorium was included with this.
Seems like tis project should have been given a lot of study and research before it was approved.
When will the citizens become the first priority here in OV??????????
