I'm sure we all recall the recent issue where the Oro Valley Council opted to allow other qualified candidates who wish to serve on the Board of Adjustment an opportunity, rather than accept the only 3 individuals that submitted applications.
Well, there was a big uproar, and in fact one of our bloggers, "Boobie-baby" who has been
inconspicuous lately, had this to say on an earlier posting:

"Who sits on the Board of Adjustment is tiny potatoes. They hear relatively few cases, and those they hear may involve someone who wants his garage to jut out more toward the street, or who wants to build around a boulder in his back yard."
Well--at the next Board of Adjustment hearing on July 23 at 3:00PM, they'll hear a case that "ain't tiny potatoes."
Keep in mind, this board can override a town council decision.

Don't be surprised if the individual representing Ventana is Gregg Forszt. Those of us who were in the SOVOG group (Stop Oro Valley Outrageous Giveaways) trying to stop Vestar's $23.2M giveaway, will recall the name Greg Forszt. He was Vestar's "stooge" when they needed an Oro Valley citizen to do their bidding during our Superior Court cases. SOVOG fought to allow the citizens their right to vote on these giveaways which ultimately ended up with Vestar bringing us a Wal-Mart for our $23.2M.
Just a note: The aforementioned Forszt happens to be the Chairman Elect of the Northern Pima County Chamber of Commerce. However, I believe we can expect the Board of Adjustment members to rule without any bias on this variance request.
One last point. The previous council which included Parish and Dankwerth recently approved a 60' hotel at Innovation Park, when the code said "no hotel," and no structure higher than 36'.

What makes anyone think that the Board of Adjustment or the TOV Council would say "No" to "Beloved Ventana"?
Ventana complained about Monterey Homes and TOV had to buy the land next door to Ventana at nearly five mil to build something else that Ventana would approve.
We all remember the 60' hotel. The developer wanted 75'!
It seems we are building an urban island of high rise buildings in what was a beautiful desertscape! No surprises here!

But certainly unfortunate.
It appears that the real reasons for only the "tiny potatoes" hitting the Board of Adjustment in past times is the probability
that anything and everything that the developers/proprietors wished for was approved in advance to that potential necessity by the P&Z, DRB, and Council. It also appears that in this instance and for some reason it was not business as usual. Sooooo - what's the deal?
OV zoning regs state that Oro Valley "shall be of low profile" and THAT is one of the BASIC foundations/tenets for the development of this community.
