Crematorium---Follow-Up

Most of our readers will recall that a group of our neighbors attempted to have their complaint about a crematorium scheduled to be built in their neighborhood heard by the Oro Valley Board of Adjustment.

When the town refused, the group known as "NIMBY" saw fit to go to court. The owners of the crematorium, the Harpold/Wagner Family joined the suit as Intervenors.

On May 10th, Judge Kelly decided against the residents, allowing the crematorium to proceed. That should have ended the litigation. However, the crematorium owners, who, as we said, entered the case as Intervenors, filed an application against the homeowners for over $25,000 in attorneys' fees.

That hearing was held on June 25th in Pima County Superior Court. Superior Court Judge Kelly ruled that NIMBY would NOT have to pay the Harpold/Wagner Family Attorneys' fees.

One small victory for the people!

That is great news for the people who stuck their necks out so we could be heard. It upsets me tremendiously that all they wanted was for Oro Valley to hear them out. Instead they were ignored and forced to go to court.
Oro Valley now has a terrible reputation due to many of the OV Council members giving into the developers instead of listening to the people who elelcted them. So let's see how many incumbents are left after the elections next year!

I suggest that it would be appropriate for the Vistoso Memorial Chapel and CREMATORIUM to have a plaque commemorating the TOV Council and Sarah More who were responsible for approving this development.
